Terms of service.

Welcome to Detect Technologies Inc. (“Detect,” “we,” “our,” or “us”).
These Terms of Service (“Terms”) govern your access to and use of our websites (detectinspections.com, detect-inspections.com) and all related software, mobile applications, APIs, and services (collectively, the “Services”).

By accessing or using our Services, you agree to these Terms and our Privacy Policy (collectively, the “Agreement”). If you are entering into this Agreement on behalf of an organization, you represent that you have the authority to bind that organization.

1. About Detect

Detect Technologies Inc. provides an AI-supported platform to help utilities and industrial operators prevent operational and equipment failures. Our system enables data capture, analysis, and inspection management using artificial intelligence and cloud infrastructure.

2. Eligibility and Accounts

To use the Services, you must:

  • Be at least 18 years of age (or the legal age of majority in your jurisdiction);

  • Provide accurate, current, and complete information when registering; and

  • Be responsible for all activities occurring under your account.

You are responsible for maintaining the confidentiality of your credentials and must promptly notify support@detectinspections.com of any unauthorized access or use.

3. Commercial Terms and Customer Agreements

Detect may enter into separate written agreements with enterprise or contractual customers (“Customer Agreements”) that specify pricing, payment, service levels, data handling, and other terms.

If you access or use the Services without a separate written Customer Agreement (such as through a free trial, demo, or pilot), these Terms solely govern your use of the Services.

In the event of a conflict between these Terms and a Customer Agreement, the Customer Agreement shall prevail.
If you are using the Services under a Customer Agreement, your access and use are also subject to that agreement’s terms.

4. Project Data and Customer Content

You or your organization may upload inspection imagery, annotations, and other related materials to the Services (“Project Data”). Project Data may include visual, sensor, or metadata collected during inspections or operational activities.

You (or your organization) retain full ownership and all intellectual property rights in your Project Data. Detect does not claim any ownership over it.

By submitting Project Data, you grant Detect a limited, non-exclusive, worldwide license to host, store, process, and analyze the data solely for the purpose of:

  • Providing, maintaining, and improving the Services;

  • Generating analytical outputs (e.g., defect detection, component classification, reports); and

  • Complying with legal or contractual requirements, including obligations under applicable Customer Agreements.

Detect will not use Project Data for marketing, training unrelated AI models, or disclosure to third parties except as described in our Privacy Policy or an applicable Customer Agreement.

Derived Outputs: Analytical results, reports, or derived data generated by the Services based on Project Data (“Derived Outputs”) may be used by you for your internal business purposes. Detect retains ownership of any underlying software, algorithms, and analytical methods used to produce those outputs.

Confidentiality: Detect treats all Project Data as confidential information and will not disclose it to third parties except as required to provide the Services, comply with law, or as authorized under a Customer Agreement.

5. Data Handling, Retention, and Deletion

Detect manages data in accordance with its Privacy Policy and internal Data Retention and Deletion Policies. We retain information only for as long as necessary to deliver the Services, comply with legal requirements, or fulfill contractual obligations.

Requests for deletion or export of personal data may be submitted to support@detectinspections.com.

6. Integrations and Third-Party Services

Our Services integrate with third-party providers such as:

  • SendGrid (for email communications);

  • Google Cloud Platform (GCP) (for hosting, storage, and data processing); and

  • Other internal and partner AI systems.

These third parties operate under their own terms and privacy policies. Detect is not responsible for the availability or operation of third-party systems, but takes reasonable steps to safeguard data shared through integrations.

7. Acceptable Use

You agree not to:

  • Use the Services for unlawful, harmful, or fraudulent purposes;

  • Reverse engineer, decompile, or interfere with the Service’s technical infrastructure;

  • Circumvent security features or access areas you are not authorized to use; or

  • Upload, transmit, or distribute malicious or infringing content.

Detect reserves the right to suspend or terminate accounts violating these Terms.

8. Intellectual Property

All intellectual property in the Services, including software, models, databases, and content, is owned by Detect or its licensors. You may use the Services only as expressly permitted by these Terms. You may not copy, modify, distribute, or use any portion of the Services beyond their intended purpose.

9. Privacy and Security

Detect’s collection and processing of data are governed by our Privacy Policy. We implement administrative, technical, and physical safeguards consistent with industry standards and our infrastructure on Google Cloud Platform (GCP). Detect does not sell personal data and processes information only as described in the Privacy Policy.

10. Service Availability and Maintenance

Detect may occasionally perform maintenance, updates, or other service interruptions. We strive to minimize downtime and, where feasible, will provide notice of any significant outages.

11. Disclaimer of Warranties

The Services are provided “as is” and “as available.” Detect makes no warranties, express or implied, regarding the operation, performance, or reliability of the Services, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

To the fullest extent permitted by law:

  • Detect and its affiliates shall not be liable for any indirect, incidental, or consequential damages, including lost profits or data; and

  • Detect’s total aggregate liability under these Terms for any claim shall not exceed the amount paid by you (if any) for the Services during the six (6) months preceding the claim.

Some jurisdictions do not allow certain limitations; these may not apply to you.

13. Termination

We may suspend or terminate your access to the Services if you violate these Terms, pose a security risk, or engage in fraudulent or unlawful activity. Upon termination, your license to use the Services ends immediately. Sections 3, 4, 5, 8, 9, 11, and 12 shall survive termination.

14. Governing Law, Export, and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules. Any dispute shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to their jurisdiction.

You agree to comply with all applicable export control and trade laws and will not use the Services in any jurisdiction or for any purpose prohibited by U.S. law.

15. Changes to These Terms

We may modify these Terms periodically. Updates will be posted with a new “Last Updated” date. Continued use of the Services after changes take effect constitutes your acceptance of the revised Terms.
